The annuity contract and the tax account holding it are separate records. A traditional IRA, Roth arrangement, employer plan and nonqualified annuity can have different rules. Begin by identifying the actual account and source of funds.
IRS Publication 575 distinguishes nonperiodic distributions from annuity payments. Before the annuity starting date, a nonperiodic distribution from a nonqualified contract is generally allocated to earnings first, subject to applicable exceptions. Do not assume every withdrawal contains a proportional tax-free return of cost.
Prepare the tax record
| Record | What to identify | Question for professional review |
|---|---|---|
| Account wrapper | Exact account or plan type | Which tax rules apply? |
| Funding | Contributions and transferred amounts | What was previously taxed? |
| Basis | Investment-in-contract history | Is the record complete and correctly allocated? |
| Payment form | Withdrawal, surrender or annuitized payment | Which calculation method applies? |
| Earlier transactions | Exchanges, withdrawals and distributions | How did they affect remaining basis? |
| Reporting | Available Forms1099-R and other records | Do the forms reconcile with the transaction? |
"Nonqualified annuity" does not mean the same thing as every nonqualified employer retirement plan. Keep the actual legal account and contract classifications explicit. Do not substitute a marketing label for the tax record.
Separate periodic and nonperiodic questions
If considering regular income, ask which tax method applies to those payments. IRS Publication 939 addresses the General Rule; other arrangements use different methods. A recurring withdrawal is not automatically treated as an annuitized payment for every tax purpose.
If considering a lump sum or partial withdrawal, ask about taxable earnings, basis and any additional tax. Age alone does not establish every exception. Keep federal and state questions separate.
Reconcile before and after a transaction
Provide the records to a qualified tax professional before a separately authorized action. Ask the insurer which reporting information it will supply and preserve any unresolved basis issue.
After processing, compare actual proceeds and forms with the reviewed assumptions. This worksheet does not calculate a personal tax bill, choose an account or recommend converting or moving retirement funds.
