A retirement-plan rollover and a section 1035 insurance-contract exchange are different transactions. Start with the exact source account and destination contract. The fact that both involve an annuity does not make their requirements interchangeable.
The IRS's 2026 reporting instructions describe eligible 1035 exchange categories. They do not make every replacement tax-free. A retirement-account movement must be evaluated under its own rollover or transfer rules.
Classify the proposal before signing
| Question | Record to gather | Issue to resolve |
|---|---|---|
| Source | Current account and contract | Is this retirement-plan, IRA or nonqualified money? |
| Destination | Exact receiving account and contract | Is the proposed destination eligible? |
| Transfer path | Written administrator instructions | Who receives and sends the funds? |
| Tax classification | Professional review | Is this a rollover, transfer, exchange or taxable distribution? |
| Existing rights | Old contract and current values | Which charges or benefits would be lost? |
| Reporting | Expected confirmations and tax forms | How will the transaction be recorded? |
An annuity-to-life-insurance transaction is not an eligible 1035 category merely because both are insurance products. The actual parties, contract types and transaction structure matter. Ask professionals to identify the applicable rule.
Keep tax and contract reviews separate
An eligible tax-deferred movement can still impose surrender charges, remove an older guarantee or start a new restriction period. Compare the old and new contracts even when tax treatment is favorable.
For a retirement-plan distribution, ask the administrator about direct handling, withholding, eligibility and deadlines before accepting a payment personally. Required minimum distributions are among the amounts that cannot be rolled over. Do not assume that every distribution is eligible.
Preserve evidence without issuing instructions
Keep the reviewed proposal, professional explanation, administrator requirements and accepted transaction confirmations. If funds or forms differ from expectations, resolve the mismatch before declaring completion.
This worksheet does not initiate a rollover or exchange. It does not determine individual eligibility, waive a deadline or recommend moving money from a workplace plan, IRA or existing contract.
