Annuity delivery, free-look and replacement

An annuity replacement involves two contracts and several separate decisions. Delivery of a new contract does not by itself prove that replacing the older one is beneficial, that a transfer is tax-free or that the old contract can be restored.

Start by verifying what was issued and which review rights apply. Cancellation periods and return procedures depend on the applicable contract and state rules; do not use one nationwide deadline.

Build the two-contract record

Record Old contract New contract
Values Current accumulation and surrender figures Actual issued premium and values
Guarantees Existing guaranteed terms and conditions New guaranteed terms and conditions
Charges Remaining surrender and adjustment terms New charge and adjustment schedules
Income and death benefits Rights being given up Rights actually issued
Delivery and review Any relevant existing rights Receipt evidence and applicable free-look instructions
Tax and transfer Source account and basis records Proposed transaction classification and reporting

Request the written explanation of why replacement is recommended and which alternatives were considered. The NAIC's best-interest model is a regulatory framework; actual state requirements and the professional's role must be verified.

Keep instructions from outrunning review

Suppose a new application is accepted on different terms from the proposal. Compare the issued version before relying on the original illustration. Ask how an outstanding transfer request or cancellation instruction affects available choices.

If returning a newly delivered contract, follow the insurer's applicable written procedure and retain timely evidence. Ask how the refund is determined and where funds would go. Do not assume cancellation will reinstate an old contract, reverse taxes or undo market effects.

Reconcile after a separately authorized decision

Retain applications, issued documents, disclosures, delivery evidence, accepted elections and confirmations. Ask the insurers to explain any mismatch between expected and actual transferred values.

A replacement review should identify lost benefits and newly imposed restrictions as well as possible advantages. This worksheet organizes that comparison without recommending an exchange, surrender or purchase. Tax and legal consequences require review of the actual facts.
