Social Security Fairness Act: WEP and GPO repeal

The Social Security Fairness Act repealed the Windfall Elimination Provision, or WEP, and the Government Pension Offset, or GPO. If an older retirement article still treats those reductions as continuing for every future benefit month, check its date and compare it with SSA's current explanation.

What changed, and for which benefit months?

SSA says the law was signed on January 5, 2025. Its legislative bulletin applies the repeal to benefits payable for months after December 2023; WEP and GPO still apply to months before January 2024. Keep the benefit month separate from the day a payment appears in an account.

The SSA implementation page identifies certain people receiving pensions from work not covered by Social Security, including some CSRS retirees, as potentially affected. It explicitly warns that not every public employee receives an increase. A federal job title, pension or retirement-system label alone does not establish that SSA owes an adjustment to a particular person.

Start with your own SSA notice

Use the following worksheet to organize a conversation with SSA. Keep benefit notices and identifying details in your own records rather than attaching them to a general insurance inquiry.

Item to identify privately Question to take to SSA
The benefit being discussed Is this my own retirement benefit, a spouse's benefit or a survivor benefit?
The relevant benefit months Which months were reviewed and which rules applied to them?
Any adjustment notice What does the notice say changed, and what remains unchanged?
An application that was never filed What current application process should I use for the benefit I am asking about?
A record that appears inconsistent What evidence does SSA need, and through which verified channel?

Avoid combining separate rules

An SSA adjustment does not provide a complete retirement-income plan. Keep questions about the federal pension calculation, CSRS Offset, the FERS supplement, Medicare premiums and taxes on separate lines. Ask the responsible agency or professional to address each one rather than assuming the WEP/GPO repeal supplies every answer.

For example, a retiree reviewing an SSA adjustment may also have an older federal pension estimate. Compare what each document actually measures and who issued it. A difference between the two documents is a reason to seek clarification, not evidence that one agency has recalculated the other's benefit.

Use a verified route for follow-up

Navigate to SSA through an official address you have checked independently. If someone contacts you about an alleged adjustment, verify the request before sharing records or payment details. This website cannot access your SSA account, establish an entitlement or promise a back payment.
